Rules of Shenzhen Municipality on Subdistrict Offices
（Adopted at the 40th executive meeting of Shenzhen Municipal People‘s Government on November 28， 1992. Promulgated by Decree No.8 of Shenzhen Municipal People’s Government on January 25， 1993.）
Chapter Ⅰ General Provisions
Article 1 In order to strengthen the construction of subdistrict offices in Shenzhen Municipality， build close relations between governments and residents， and strengthen city construction and administration， these rules are formulated according to the provisions of relevant state laws and regulations， combining with the actual circumstances of Shenzhen Municipality.
Article 2 Subdistrict office is an agency of the people‘s government of a district under Shenzhen Municipality （hereinafter referred to as the district people’s government）。 Subdistrict office shall be under the leadership of the district people‘s government， and exercise the functions and powers authorized by the district people’s government.
Article 3 The zoning of the administration areas of subdistrict offices shall be decided on the basis of city‘s natural conditions， resident’s inhabiting situations， and follow the principle of making it easy to contact with residents and carry out works. The population of each administration area would better be 40，000 to 60，000 generally.
Article 4 The foundation， amalgamation， cancellation， or change of administrative area of a subdistrict office shall be approved by the Municipal People‘s Government of Shenzhen.
Article 5 The municipal and district departments of planning shall bring the construction of subdistrict offices into the general planning of the city construction.
Chapter Ⅱ Duties and Powers
Article 6 Subdistrict offices shall take charge of the community construction in culture， develop the construction of civilized street， civilized unit and civilized building， abolish feudalistic superstition， break away with blind faith， alter old customs and habits， and organize residents to go in for regular activities of culture or sports.
Article 7 Subdistrict offices shall cooperate with relevant departments in the work such as birth control， public security， civil affairs， urban construction， house management， industry and commerce， tax， price， air defense， fire prevention， wind prevention， flood-prevention， taking precautions against earthquake， rescue and relief， housing reformation and resident migration， etc.
Article 8 The subdistrict office shall mobilize the masses to carry out patriotic health and sanitation campaign， make the urban environment green， beautiful and clean， and assist relevant department in the work of environmental sanitation and environmental protection.
Article 9 Subdistrict offices shall take charge of the work of people‘s mediation and safeguarding public security， improve the help， education and reform to the delinquent， and protect the legal rights and interests of the elderly， the female and children.
Article 10 Subdistrict offices shall assist relevant departments to accomplish the work of civil affairs， such as giving special care to and settling the disabled servicemen and their family members， social relief， marriage registration administration， funeral and interment reformation， and employment of disabled persons， accomplish the operation of baby farm ， kindergarten and activity center for the elderly or youngsters， and positively develop community service and education for residents‘ convenience.
Article 11 Subdistrict offices shall assist the labor department in managing the unemployed， and recommending them jobs， and assist the department of arms and the draft organization in the citizen‘s performance of military service.
Article 12 Subdistrict offices shall direct， support and help the urban residents‘ committee to strengthen the construction of ideology， organization and system， carry out regularly the appraisal and commendation of advanced urban residents’ committee， and reflect the resident‘s opinions， suggestions and requirements to the superior people’s government and relevant department in time.
Article 13 Subdistrict offices may convene the leading officials of the government unit， group， army， enterprise or institution within its administration area to have a meeting to coordinate and solve the problems in respect of the administration and community service within its administration area.
Article 14 Subdistrict offices may inspect， supervise and urge the police substation of public security， tax office， administrative office for industry and commerce， administrative office of house， school and hospital in its administration area to accomplish community service， and may assign the task of community service jointly with the competent departments of relevant units when necessary.
Article 15 Subdistrict offices shall support and develop the collectively-owned enterprise in cities and towns， create conditions to develop street economy according to the Regulations of the People‘s Republic of China on Collectively-owned Enterprises in Cities and Towns， and accomplish the planning and coordination of collectively-owned enterprises in cities and towns in its administration area under the precondition of safeguarding the enterprise’s decision-making power.
Chapter Ⅲ Organization and Structure
Article 16 A subdistrict office shall have one director， and one or two deputy directors to assist the director in working.
Article 17 Subdistrict office shall set up the system of office meeting of directors and follow the principle of democratic centralism. The major issues concerning the street shall be submitted to the office meeting of directors for discussion and determination.
Article 18 Subdistrict office shall set up the system of the meeting of residents‘ representatives. The meeting of residents’ representatives shall be convened once a year at least. Subdistrict office shall report work to the residents‘ representatives， listen to their opinions， accept their supervision and discuss the major issues in its administration area with them together.
The quota and determination method of residents‘ representative shall be determined by subdistrict office according to actual circumstances， and shall be reported to the district competent department of civil affairs for record.
Chapter Ⅳ Relation with Government Department
Article 19 No working department subordinated to the municipal or district people‘s government may assign task to subdistrict office directly. The task， whose accomplishment needs the subdistrict office’s assistance， shall be arranged and assigned by the municipal or district people‘s government.
Article 20 Relevant functional department of municipal or district people‘s government may set up accredited agency at subdistrict office according to its working needs， after getting an approval of municipal or district people’s government. The accredited agency shall respect the functions and powers of subdistrict office， accept its coordination， and assist its work.
Chapter Ⅴ Supplementary Provisions
Article 21 The municipal competent department of civil affairs may enact concrete implementing measures according to these rules.
Article 22 These rules shall go into effect as of the date of promulgation.
